1. Acceptance of Terms

Welcome to Cafia ("we," "us," or "our"). By accessing or using our website (or any subdomain), placing an order, making a reservation, or otherwise using our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

By using the Services, you represent that you are at least 18 years of age or have the consent of a parent or guardian. If you are using the Services on behalf of an organisation, you are agreeing to these Terms for that organisation and confirming that you have the authority to do so.

2. Description of Services

Cafia operates a restaurant and café in Bharatpur, Chitwan, Nepal. Through our website, we offer:

  • Online menu browsing and digital ordering for pickup or delivery
  • Table reservation requests
  • Information about our location, opening hours, and promotions
  • Customer support via phone, WhatsApp, and email

We reserve the right to modify, suspend, or discontinue any aspect of the Services at any time without prior notice. We are not liable for any modification, price change, suspension, or discontinuation of the Services.

3. Orders and Pricing

All prices are displayed in Nepalese Rupees (NPR) and are inclusive of applicable taxes unless stated otherwise. We strive to keep our menu and prices accurate, but errors may occur. In the event of an error, we reserve the right to correct the price and contact you to confirm whether you still wish to proceed.

When you place an order, you are making an offer to purchase. We may accept or decline that offer at our sole discretion. An order is considered accepted only when you receive a confirmation from us (via the website, WhatsApp, or phone).

We may limit the quantity of items ordered, refuse service, or cancel orders at any time, including after an order has been confirmed. If we cancel an order for which payment has already been made, we will refund the full amount to the original payment method.

4. Payments

We accept the following payment methods:

  • Cash on Delivery (COD) – Pay in cash when your order is delivered.
  • QR Payment – Scan the QR code at checkout and complete payment via mobile banking. You must upload or show the payment confirmation when requested.
  • In‑Person Payment – Pay at the counter for dine‑in or pickup orders.

For QR payments, your order is subject to verification of payment. We are not responsible for failed transactions due to network issues, insufficient funds, or incorrect bank details provided by you. You agree to provide true and accurate billing information.

5. Cancellations and Refunds

By the Customer: You may cancel an order before it has been accepted by us. Once accepted, cancellations are at our discretion. If cancellation is approved, any refund will be processed within 7–10 business days to the original payment method. For COD orders, there is no refund applicable unless the order has been paid in advance.

By Cafia: We may cancel an order if the item is out of stock, we are unable to deliver, or we suspect fraudulent activity. In such cases, a full refund will be issued if payment has been made.

Refund Exceptions: Refunds are not provided for food quality complaints unless the complaint is verified by our management. We may offer a replacement or credit at our discretion.

6. Reservations

Reservations made through the website form are requests only. A reservation is confirmed only after we contact you directly (via phone or WhatsApp). We reserve the right to modify or cancel a reservation if we are unable to accommodate the request. Please arrive on time; tables may be released if you are more than 15 minutes late without notice.

7. User Conduct

You agree not to:

  • Use the Services for any unlawful purpose or in violation of any applicable laws.
  • Interfere with or disrupt the security or performance of the website.
  • Submit false, misleading, or fraudulent information.
  • Attempt to gain unauthorised access to our systems or other users' data.
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Services without express written permission.

8. Intellectual Property

All content on this website – including but not limited to text, graphics, logos, icons, images, audio clips, video, digital downloads, and software – is the property of Cafia or its content suppliers and is protected by Nepal and international copyright, trademark, and other intellectual property laws.

You may view, download, and print pages from the website for your own personal use, subject to the restrictions set out in these Terms. You must not:

  • Republish material from this website without permission.
  • Sell, rent, or sub‑license material from the website.
  • Reproduce, duplicate, or copy material for commercial purposes.
  • Use the Cafia logo or brand name without prior written consent.

9. Third‑Party Links and Services

Our website may contain links to third‑party websites or services that are not owned or controlled by us (e.g., Google Maps, social media platforms, payment gateways). We have no control over and assume no responsibility for the content, privacy policies, or practices of any third‑party sites or services.

You acknowledge and agree that Cafia shall not be liable for any damage or loss caused by or in connection with the use of any such third‑party content or services.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CAFIA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, REGARDING THE OPERATION OF THE SERVICES OR THE INFORMATION, CONTENT, OR MATERIALS INCLUDED THEREIN.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON‑INFRINGEMENT, AND ACCURACY OF INFORMATION.

11. Limitation of Liability

IN NO EVENT SHALL CAFIA, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SPECIFIC ORDER GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Cafia and its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or in connection with your use of the Services, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any dispute arising out of or in connection with these Terms shall first be attempted to be resolved through good‑faith negotiations between the parties. If such negotiations fail, the dispute shall be subject to the exclusive jurisdiction of the courts located in Chitwan, Nepal.

14. Changes to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting to the website. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
